Pennsylvania Supreme Court to Decide Fate of
“No-Excuse” Voting by Mail

Lawyers Democracy Fund (LDF) Vice President Tom Spencer and litigator Wally Zimolong are available to speak to the media regarding the LDF-backed challenge to Act 77, Pennsylvania’s no-excuse absentee voting law, in McLinko v. Commonwealth (No. 224 M.D. 2021) consolidated with Bonner v. Degraffenreid (No. 293 M.D. 2021), to be argued on March 8 in front of the Pennsylvania Supreme Court. The Commonwealth Court ruled that no-excuse voting by mail is clearly unconstitutional under Pennsylvania’s Constitution.

This case has received attention from national media from The New York Times to Fox News and from politicians from Donald Trump to Tom Wolf. LDF experts can break down how the case is really about the Pennsylvania Constitution and voters, not about politicians and past elections.

Mr. Spencer is a distinguished attorney recognized nationally as an expert in the field of election law with over 40 years of experience. He worked on the 2000 Bush v. Gore recount and represents candidates and campaigns domestically and internationally and assists with ethics and compliance issues. Mr. Spencer speaks in his personal, and not his official or professional, capacity.

Mr. Zimolong is a veteran trial lawyer with vast trial experience having acted as lead plaintiff or defense counsel in nearly 500 cases in federal and state court, private arbitration, and before government administrative law judges. Mr. Zimolong is representing Bradford County election official Doug McLinko in his challenge to Pennsylvania’s Act 77. He successfully argued the case before the Pennsylvania Commonwealth Court.
